Mr. C.Q. was vaguely identified by a homeowner as the person she saw stealing property inside her house. A neighbor positively identified Mr. C.Q. as the only person leaving the vicinity of the same house that had just been burglarized. Mr. C.Q. had a recent prior felony conviction so he was offered a prison plea offer to a fraction of the prison time he would face if found guilty at trial. After a jury trial the jury was hung at 6-2 not guilty. A re-trial was set. Prior to the second trial, the State offered Mr. C.Q. a plea offer to probation and the case settled favorably.
